In exchange for that commitment, Leaper Tourism will not request additional payments nor deposits as everything is paid up front in exchange for the service. The only exception to this norm will be identified in the “Acts of negligence and Damages while in Costa Rica PDF”

A valid payment method is required for the services to be provided. Without a valid payment method to pay for services, the service contract will become null and services will not be provided. An email confirmation will be sent to the customer if services are deemed terminated due to a lack of a valid payment method.

This will be charged in person and by having a written signature of the “Penalty and Negligence” form.

Terms for use and reference while understanding the Conditions and Privacy Policy

Authorized Representative: An authorized representative is an individual from the Leaper Tourism travel team. Currently, Alonso Zevallos and Gloriana Quesada are working as authorized representatives for the company. For legal purposes and representation, only Alonso Zevallos is in the capacity to represent the firm.

Leaper Tourism: Is the name of the official trademark registered for intellectual property in Costa Rica. Names also captured within the organization which are used interchangeably are: Leaper Travel, Leaper and Leaper Costa Rica.

Merchandise: Leaper Tourism will offer merchandise throughout the tours and will coordinate their sale before and after trips in case any user desires as souvenirs. These are thought to be accessible only for actual customers and the price of these would be considered add-ons unless specified in the Travel Expense Proposal PDF. These are in the sole interest of the user and are not required nor added to the fees unless requested by the user.

Third Party Vendors: In Costa Rica, Leaper Tourism will offer a series of recommendations that will not be contemplated in the Travel Expense Proposal PDF, these may vary from accommodations all the way to places to eat and transportation. All recommendations are based on the knowledge and previous business relationships that Alonso Zevallos has had with the vendors but are not direct partnerships unless specifically stated in the Travel Expense Proposal PDF. These should not be considered as part of the services provided by Leaper Tourism and therefore exclude Leaper Tourism representatives and the firm from any liability with regards to service. Any dispute or reimbursement as well as complaints should be brought up with the third-party vendors themselves. Leaper Tourism will also attempt to mediate in the case that mediation is required or available.

Leaper Tourism will also work in favor of the customer to obtain a resolution favorable to the customer even if not possible. This still excludes Leaper Tourism from any liability with 3rd party vendors and the services being contracted.

Recommendations: Leaper Tourism works based on recommendations. These recommendations mean that the places, content, and experiences have previously been enjoyed by Leaper representatives as well as other tourists within the last 2-4 weeks. Recommendations are places or activities meant to be enjoyed by all audiences. Recommendations may not necessarily be added to the Travel Expense Proposal PDF as they may be services or activities provided by Third Party Vendors.

Leaper Tourism will always aim to build the best experience for the user. Nonetheless, if circumstances outside of Leaper Tourism’s control happen which hinder the user’s experience, these will be considered an immediate forfeit of liability for Leaper Tourism as all packages are thoroughly explained and agreed upon to by the primary user or an authorized user.

Nonetheless, Leaper Tourism, at their sole discretion can provide an alternative solution or outing to a recommendation failure. If agreed by the users and Leaper Tourism, they will be then provided with a conciliation for the failed recommendation.

Identification: Leaper Tourism always encourages travelers to always carry some sort of identification when traveling through Costa Rica. Costa Rica is a stop and ID country which does not exempt foreigners from identifying with local authorities. This is also a safety measure Leaper Tourism encourages all travelers to abide by.

Leaper Tourism will carry a backpack with space to safely store your identification. Just make sure you let a Leaper Authorized Agent know if you would like to have your ID stored with one of your guides.

Conciliation model

Failed Recommendation: All activities are meant for all to enjoy. Sometimes, things can happen which make your experience tainted. In those cases, a failed recommendation will be considered a recommendation that failed to meet your experience expectations. Please contact Leaper Tourism for a possible solution to this if this ever happens.

In those cases, Leaper Tourism will assume the cost of $20.00 per member in the group for tickets or reservations at a new recommendation agreed by the users (primary approval is not required as this will be deemed by consensus of the traveling group). The primary user will be charged for travel expenses and any costs outside of the allowed amounts which will be notified in advance and agreed upon on site.

User fails to participate: If the user is not willing to participate in an activity or is unwilling, the user automatically forfeits their right to conciliation as the activities have previously been discussed and agreed upon by the Primary and Authorized users. Reconciliations will only be granted if the experience expectations are not met due to conditions outside of the control of the users and Leaper Tourism. For example, rain during the outing, medical accommodations or acts of God outside of Leaper’s Control.

Experience Expectations: The expectation Leaper Tourism seeks for all its users, is the ability to enjoy an activity or excursion which challenges all of its members in a moderate fashion, while incentivizing cultural, political, physical or emotional appreciation for the values Leaper’s have. These may be perceived differently by all users so Leaper Tourism will always try to gather immediate feedback in the form of surveys and verbal polls to ensure all participants are actively engaged and enjoying the adventure.

Group or Person: A group is defined as 2 or more individuals where at least one of the users is considered a Primary User and has binded services to be provided by Leaper Tourism. A person is a Primary User traveling alone that has binded services to be provided by Leaper Tourism.

Binded service: The service will be considered “binded” or “sold” the moment the primary user or an authorized user (with approval of the primary user) sends an acknowledgment and affirmation email reply to the Travel Expense Proposal PDF.

If any modifications required which elevate or decrease the initially quoted price will immediately rescind the Travel Expense Proposal PDF email forcing a new acknowledgement and affirmation email to be issued by the primary user or authorized user unless contradicted by a primary user.

Primary user: A Primary User is defined as the individual that first initiates contact with Leaper Tourism and serves as the “primary” contact for a group or person traveling to Costa Rica and contracting Leaper Tourism’s services. The primary user has the ability to:

  • Request changes to any travel package prior to binding

  • Request Authorized Users to be added

  • Contact Leaper Costa Rica authorized representatives

  • Request information including any opt out requests

  • Manages the travel itinerary for the group or person traveling to Costa Rica prior to binding

Authorized user: Authorized users are users that are approved by the Primary User to engage in conversations and make decisions regarding the travel packages and expenses proposed by Leaper Tourism. In the case of differences between the primary user and authorized users, the word of the primary user will always be considered before the authorized user.

First Aid: All Leaper Costa Rica guides (Alonso Zevallos) have certified CPR + First Aid training. The first aid kit and respective equipment are up to date and constantly monitored by the team. Details and instructions on how the equipment is maintained and monitored is included in the Safety Protocols & Procedures guidelines available to all Leaper Tourism representatives.

Instructions: At the start of all daily activities, the Leaper Authorized Representative will be tasked with sharing a list of instructions that will optimize the experience during the journey and minimize the amount of intervention required by the guides (which could hinder the experience).

All users should pay attention to these as instructions will also be shared via email to the primary user prior to arrival at Costa Rica. For that reason, acts of negligence will be deemed as a possible cause of injury or damage which Leaper Tourism will not be held responsible for.

Security tips:  Costa Rica is a country where security is high. All the guides have been instructed on maintaining the highest security measures possible and all of the hikes including adventures are meant to be low security threats. Nonetheless, proceed with common sense and caution and listen to the guides in case any action is deemed unsafe. Leaper Tourism will always accompany all users and provide the user with tips to avoid any common risks to ensure there is always a positive experience maintained.

Guidelines including safety monitoring and protocols to follow in case of medical, physical or any sort of emergency are included in the Safety Protocols & Procedures guidelines.

Purchasing during the trip

Purchasing at local stores is highly encouraged. Nonetheless, to avoid over-priced goods, please make sure that you consult with your Leaper Guide to avoid overpaying. Please make sure that you are also accompanied by the entire group to avoid being singled out.

Interacting with locals

Costa Ricans are extremely friendly individuals. Meaning that it is extremely likely that someone will approach you to take a picture, offer you their insights on “where to visit”, ect. Nonetheless, for your safety and comfort, please refrain from engaging with locals unless your guide is with you and can escort you to avoid uncomfortable situations. It is extremely likely that no incidents will happen and that there is no ill intent with communicating with locals. Nevertheless, this way avoids risk to you and to the group.

Costa Rican weather

Costa Rica is a country that has extensive rainy seasons. For that reason, we always encourage packing a raincoat and rain gear especially between August and December as these tend to be the main months for rain in the country. There have been rain forecasts between mid-May and mid-December, so we will also request a raincoat if there is a weather forecast suggesting rain during the travel hire dates.

Costa Rica’s climate makes it so that humidity levels tend to be high all year round. For that reason, it is important that we understand our physical limitations and advise your guide whenever you feel over exhausted or overheated. The risk of heat stroke or hypothermia is extremely low in the country. Nonetheless it is an extremely important measure that all travelers must abide by communicating any sort of physical, mental, or emotional discomfort when encountered.

Services offered to enhance physical security:

Leaper Tourism will also include sunblock and insect repellent as part of the included features when traveling to Costa Rica. Please review the tag on the products used for any allergens prior to using these. As these are gifted accommodation on behalf of Leaper Tourism, Leaper Tourism cannot be held liable if the available products cannot be used or cause an allergic reaction when clearly disclosed in the tag. All the available products are bought newly for every group and are correctly stored to avoid any undesired secondary reactions.

In case that the sunblock or insect repellent cannot be used as they pose an allergic reaction threat, the primary and authorized users are responsible for acquiring their own sunblock and insect repellent that matches the individual’s needs. Leaper Tourism will assist in locating these products to avoid any discomfort during the trip.

If the information you are looking for is not available, please contact www.leapertravel.com for support as these terms and conditions contemplate a wide range of scenarios and conditions.

Available Products: These are products that Leaper Tourism has available for all members of the travel group. These are included but not limited to:

  • Water bottles

  • Sunblock

  • Insect repellent

  • Ponchos in case of rain

  • T-shirts

It is important to note that these do not represent an “additional” cost to the user as these are already contemplated into the service expenses.

Transaction information

Since all payments are performed with in-person verification, only the dataphone or the PayPal registry can retain your payment details. Leaper Tourism will abide by the security protocols requested by our financial institution as well as PayPal to safekeep your payment method information. Access to this information will only be available to Alonso Zevallos and representatives authorized by our financial institution.

Payment will be conducted in person through a dataphone or PayPal transfer. The reservation is confirmed via one of our authorized representatives with the use of the Travel Expense Proposal PDF document included in the signing email. Confirmation is required prior to payment.

Taxes while in Costa Rica:

All business and commerce are required to pay the IVA Tax (VAT Tax) 13% in Costa Rica. This tax is not exemptible.

Business Relation: Leaper Tourism will deem the business relation as the window of time in which Leaper Tourism is responsible to maintain and safeguard your information.

The business relation starts the moment the user provides their email address willingly to Leaper Tourism. The business relation then is maintained for 90 days upon delivery of the service hired by the primary/authorized user. On day 87 upon delivery of the service, Leaper Tourism will send an email to request affirmation that Leaper Tourism can in fact delete the information that was requested to provide the service. If the customer chooses to, the business relation may be extended if they desire to continue receiving newsletters or updates.

Leaper Tourism will send emails requesting affirmation of deletion of information on Day 87, 88, 89 and 90. If the customer fails to provide affirmation, we will automatically delete the information stored by Leaper Tourism and the customer forfeits their right to have it reinstated or dispute the service provided.

Leaper Tourism reserves the right to terminate the business relation at any time. The primary user may only request the deletion of the information after delivery of the service which will shorten the business relation. The business relation can also be modified depending on the needs of the business and the primary/authorized user.

Important Notes:

Our website and communication means serve as intermediary, or third party contracted services to facilitate communication with you and your travel group. To ensure that you have a good travel experience, we will communicate and contact other third parties in Costa Rica to reserve and contract services that are strictly related to your desired experience while in the country.

All third-party contractors have all legal requirements to operate in Costa Rica and have terms and conditions as well as privacy policies of their own to operate. Leaper Tourism will not provide any personal information from the travel group unless previously disclosed with the Primary User or the Authorized User. Affirmation of the Travel Expense Proposal PDF is required for us to book any third-party services while in Costa Rica.

All Travel Requests that will be delivered have the appropriate insurance and warranty coverages revised and required by Costa Rican law.

It is the sole responsibility of the travel group to notify arrival and departure to Costa Rica.

Transportation to and from all sites is included in the Travel Expense Proposal PDF. This already accounts for any detour that must be taken because of the following but is not limited to road closures, road maintenance, accidents, weather, mobs, etc.

Leaper Tourism travel groups are expected to be representatives of Leaper Tourism and their respective countries of origin. For that reason, good behavior and practice are required.

Leaper Tourism travel packages are not refundable nor transferable. For information on compensation including but not limited to changes to the primary package offered in the Travel Expense Proposal PDF, please visit the “Recommendations” section outlined in the Terms section of the Terms, conditions, and privacy policy.

All travel is subject to weather conditions. In case Leaper Tourism alongside with government agencies such as the CNE determine that travel is unsafe, there will be an email rescinding the Travel Expense Proposal PDF and a subsequent email will be sent with a new and amended Travel Expense Proposal PDF as an alternative proposal for the traveler. This new email will then be considered the new binding service. If the customer does not agree with the new travel proposal and has still not arrived at Costa Rica, Leaper Tourism will negotiate with the customer to draft a new proposal where travel safety is not at risk. Once that new proposal is accepted, Leaper Tourism will not be held accountable for being unable to provide services.

If the service has already been paid for and an unforeseen event happens. Leaper Tourism will attempt to accommodate as per the “Failed Recommendations” section outlined in the Terms section of the Terms, conditions, and privacy policy. Leaper Tourism cannot be held accountable for “Acts of God” or natural phenomena that is not typical in Costa Rica. Some examples include but are not limited to category 5 and above earthquakes, tsunami, political turmoil, uncontrolled forest fires, landslides, etc.

Penalties

Leaper Tourism waives the right to penalize travelers as part of their commitment while guaranteeing a good service experience. The only charges that may be incurred due to acts related to negligence and such will be disclosed in the “Acts of negligence and Damages while in Costa Rica” section.

If a third-party service is contracted prior to arrival to the country and the third party vendor requires payment up front, the customer is subject to the terms and conditions outlined by the third-party vendor and must therefore negotiate any reimbursements directly with the third-party vendor.

Documentation:

Travel groups that have children under the age of 18 must always carry the children’s passport or personal identification including all documents to prove guardianship of the child. In case the parent authorizes travel without accompanying their child, the legal guardian is required and held accountable to submit all pertinent documentation regarding the child’s travel approval including all legalized documents by the country of origin.

Failure to comply will result in the guardian’s acknowledgement of full responsibility, hence waiving Leaper tourism of any liability.

Responsibility and Obligation:

Since Leaper Tourism wants to ensure that a good travel experience is provided regardless of conditions, Leaper Tourism will only be obligated to fulfill any sort of responsibility for services that cannot be provided due to strict negligence of Leaper Tourism or its authorized representatives. The cost of the obligation will be limited to the “Recommendations” section outlined in the Terms section of the Terms, conditions, and privacy policy.

Any sort of dispute or claim filed with third-party vendors will have to be submitted directly to the third-party vendor. Leaper Tourism may serve as a mediator and will always seek to support our customer in resolving problems in the best interests of the customer.

All compensation is subject to availability from third-party vendors. This is why the negotiation and communication of alternative plans will depend strictly on the willingness and interest of the customer.

If the customer rejects all conciliation [LC3] offers as outlined in the “Recommendations” section outlined in the Terms section of the Terms, conditions, and privacy policy, the customer waives their right to be compensated.

The only exception to this rule is in the case that the customer or any of the travel members have a physical medical condition that prevents that specific activity from being conducted. An additional exception is granted whenever compensation is granted directly through a third-party vendor or a direct supplier for Leaper Tourism.

Neither Leaper Tourism nor its representatives accept any responsibility for loss, theft, or damage to the personal property of the customer in relation to the services being provided. Best practices for travel in Costa Rica are shared prior to the delivery of the service and mechanisms are placed to prevent any loss of theft. These can be read in the Safety Protocols & Procedure guidelines. Leaper Tourism will accompany the customer to make the respective reports in case of loss or theft with the Organismo de Investigación Judicial (hereby named OIJ).

The customer reserves the right to request changes to the itinerary which is subject to approval by a Leaper Travel representative.

The Travel Expense Proposal PDF will serve as the e-ticket issued by Leaper Travel and serves as confirmation of the reservation pending to be paid.

The company accepts credit and debit cards as well as PayPal payments exclusively.
